With the development of globalization and information technology,the crime of cross-border telecom fraud has developed rapidly in our country for the last 10 years,which now has become one of the most severe criminal form threatening the property security of our people.With the national borders as physical barrier and the poor efficiency of police cross-regional cooperation between different countries as a loophole,the swindlers exploit the flaw to commit this kind of crimes and maximize the "boundless"means,which make the telecom fraud one of the most difficult crimes to crackdown.These swindlers execute the long-distance and non-contact crime by the support of modern communication technology and financial instruments,while the crime could complete in different country or areas due to the crime dens and the gang members scattering overseas.Which requires the cooperation of national law enforcement authorities in order to bring the perpetrators to justice.However,during the process of international police cooperation,obstacles could be hard to overcome such as poor intelligence sharing mechanism,poor international law enforcement cooperation training mechanism,judicial vacancies,or even local protectionism.These obstacles are more or less reflected in the "8·12" cross-border telecom fraud case.Based on the analysis of these problems and their causes,this paper summarizes the advantages and experiences of the patterns of international police cooperation in other countries.This paper also puts forward the idea of perfecting the international police cooperation in fighting against the transnational telecom fraud crime in China by finding lessons,summing up experience and finally working things out.Which requires policing cooperation system established,laws and regulations of different countries linked up,transnational investigation process improved and law enforcement cooperation specialists well-trained.In addition,the justice will be accessed much more efficient through expanding international police cooperation channels and recover stolen money or goods overseas.This paper is divided into six chapters to discuss the proposition of international police cooperation on fighting against transnational telecom fraud crime.Chapter one clear and definite the subject of this paper by analyzing the research background,status and significance.The second chapter expounds the concept,characteristics and the concept of cross-border telecom fraud,and necessity of international police cooperation in this article.The theoretical basis will be discussed at the same time.The third chapter analyzes the patterns of international police cooperation at home and abroad,summarizes the outstanding experience of the European union pattern,the ASEAN pattern and the international police cooperation pattern under Interpol,and puts forward some aspects that can be used for reference in our country's international police cooperation.The fourth chapter studies the case of "8·12" cross-border telecom fraud and try to find out the reasons behind the problems by analyzing the details of the case,finding out how the international police cooperation worked.The fifth chapter studies what kind of problems in the process remained.In the sixth chapter,solutions will be proposed based on the analysis of the problems and reasons in the fifth chapter,which presenting to perfect the international police cooperation system and laws and regulations linkage,to improve the process of transnational investigation,to train qualified personnel for international law enforcement cooperation,to expand the channel of international police cooperation,and to recover stolen money or goods overseas.Conclusions will be drawn by all questions and discussions posed above in order to offers reviews and guided for international police cooperation against transnational telecom fraud crime in China.
