On The International Police Cooperation Mechanism Of Combating Transnational Cyber Crime In China

Transnational cybercrime is prone to cause great harm to society due to its transnational,covert and professional characteristics,displaying a constantly and rampantly updating trend.It is difficult to maintain safe and secure from crime in one country to rely only on its own efforts.China has been seriously impacted on by transnational cybercrime,hence strengthening effective and practical construction of international police cooperation mechanism has become a key factor of preventing transnational cybercrime.This paper is divided into four parts:Part one is an overview of transnational cybercrime,expounding mainly the three aspects of category,feature and serious harm of transnational cybercrime.Part two analyzes the international police cooperation in combating transnational cybercrime from the international perspective,focusing on the current status and barriers of fighting against transnational cybercrime through international police cooperation.Part three are difficulties in the mechanism of combating transnational cybercrime in our country,including the lack of legal constraints,the lack of crime prevention and monitoring ability,the difficulty of overseas evidence collection and cooperation and the difficulty of recovery of stolen money.The last part puts forward the measures aiming to strengthen the international police cooperation mechanism for fighting against transitional cybercrime,including eight main aspects: adhering to the national sovereignty of cyberspace and fill the legal blind area,carrying out cooperation according to the policies of the state,speeding up the construction of early warning mechanisms for network risk prevention and control,strengthening judicial cooperation mechanisms for obtaining evidence,implementing cooperation mechanisms for looking back on cases,establishing compensation and incentive mechanisms for recovering stolen goods,deepening police exchanges,enhanceing mutual trust in law enforcement and strengthen the construction of supporting mechanisms in China.
