The construction of Rule of Law Government serves as a priority and the main project for a comprehensive framework for promoting the rule of law.As the saying goes,evaluation is an investment in people and progress.“Promoting Construction by Evaluation” is in accord with Principles of Management.Considering the difficulty to quantify the construction of the Rule of Law Government,it is significant to develop an indicator system that integrates subjective and objective indictors for the objective evaluation of the Rule of Law Government construction.The indicator system aims to enhance the scientificity,feasibility and credibility of the evaluation.Therefore,how to scientifically position the structural relationship between subjective and objective indictors of the Rule of Law Government performance has become a major theoretical and practical issue in achieving evaluation functions and promoting the construction of the Rule of Law Government.The Rule of Law Government performance evaluation integrates theories and methods from multiple disciplines,such as political science,law,management,playing a role in monitoring and evaluating,driving,guiding and correcting of errors.For example,the theory of Democratic Rule of Law provides the theoretical foundation of the construction of the performance evaluation system of the Rule of Law Government.The theory of satisfaction and the theory of evidence-based management provide the value guidance and tools for the evaluation system.Meanwhile,structural theory and its application provide methodological support for the construction of the evaluation indictor system.The construction of the performance evaluation system,which is different from the the top-down legal administrative evaluation within the system,requires both the value guidance of subjective indictors and the instrumental rationality of objective indictors.It is of significance to integrate subjective and objective indicators to form a complementary and mutually evident structure and system of evaluation indicators.In the evaluation system,the indicator system determines the scientificity of the evaluation.Drawing on domestic and foreign experience and practice,especially in light of Chinas practice,the construction of the indictor system should follow the general principles of systematicity,scientificity,criticality and operability,so as to reflect the connotation and innotation of the Rule of Law Government comprehensively.The Rule of Law Government performance evaluation indictor system includes five primary indictors,fifteen secondary indictors and forty-seven tertiary indictors,including legal construction,process promotion,target achievement,legal cost and satisfactory results.The objective and subjective indictors are effectively integrated into the indictor system.Since the subjective and objective indictors have differences in emphasis and data sources,value orientations,functional roles,they can form the complementary relationship.The purpose of constructing an indicator system is to apply it.An empirical study on nine exemplary and representative cities in the Pearl River Delta region across the country found that the average performance score of the rule of law government in the region for three years(2017,2019,2021)was 81.41,with an average score of 79.00 for subjective indicators and 85.02 for objective indicators.The former was lower than the latter.The average score of subjective indicators in the region for 2021 is even 9.75 lower than the average score of objective indicators.Through the structural analysis,it can be found that subjective evaluation scores generally lower than objective evaluation.The reason for the gap(i.e.the evaluation results of subjective indictors are significantly lower than the evaluation results of objective indictors)is due to the negative impact of concepts,mechanisms,technical errors,as well as the negative impact of interaction on the rule of law government in terms of direction,process,results.A further qualitative analysis from the perspective of the Grounded Theory and based on NVivo13 software revealed that the difference between the subjective and objective evaluation results is also related to evaluation techniques,social environment and psychology of social groups.The complementary relationship between subjective and objective indictors is manifested as the complementarity of evaluation subjects,evaluation contents,evaluation methods and evaluation results.Such complementation is significant for both subjective and objective indictors considering their respective defects in the deficiencies of missing elements,structural optimization,and insufficient functionality.The value orientation of satisfaction,structuralist approach and the support of tools and techniques,especially the results of relevant empirical studies,prove that the complementarity of subjective and objective indictors is not only theoretically feasible but also practical.Therefore,the concept of complementary evaluation should be established and third-party evaluation should be actively introduced.In addition,both subjective and objective evaluations have defects such as insufficient support of subjects,deficient proof of indictor,weak persuasive power of evaluation results and limited social influence,etc.Only through mutual verification of subjective and objective evaluations can the accurate performance evaluation of the Rule of Law Government be evaluated comprehensively and accurately.The mutual verification of subjective and objective evaluation can not only develop their respective advantages,but also provide mutual correction and reinforcement,so as to improve the reliability and validity of the evaluation,and to enhance the scientificity of the indictor system.The realistic evaluation practice requires the mutual verification of subjective and objective evaluation to guarantee the structural optimization and functional amplification of the indictor system,which contributes to a high unity of value rationality and instrumental rationality in the performance evaluation of the Rule of Law Government.To address the problem that the subjective evaluation of the performance evaluation results of the Rule of Law Government is lower than the objective evaluation,to achieve mutual complementarity and proof between subjective evaluation and objective evaluation,and improve the performance of a rule of law government,it is necessary to dynamically optimize the relationship between subjective evaluation and objective evaluation,and strengthen the matching degree between subjective and objective indicators through technological innovation,By enhancing the information transparency of the rule of law government,the accessibility and authenticity of objective indicators can be improved.By optimizing the social environment of public opinion surveys,subjective indicator evaluation can be improved.By cultivating third-party evaluation subjects and evaluation markets,the reliability and validity of subjective data can be enhanced.Multiple measures can be applied together to comprehensively implement countermeasures,solve the gap between subjective and objective evaluations,and achieve scientific and effective results Fairly evaluate the performance of the rule of law government.In the process of studying the structural relationship between subjective and objective indictors in the Rule of Law Government performance evaluation,the study attempts to innovate in the following three aspects: Firstly,it aims to introduce the concept of the performance evaluation of government as well as proposing and defining the connotation of the Rule of Law Government performance evaluation and its scientific connotation based on the evaluation of legal administration.Secondly,its also in an effort to construct the Rule of Law Government performance evaluation indictor system and apply it to the empirical research on the nine forward-looking cities in PRD(the above-mentioned three years)based on a third-party standpoint so as to expand the applicability and accuracy of the constructed performance evaluation index system for rule of law government from particularity to universality,from concrete to abstract logical generalization.Thirdly,through discussing the structural relationship between subjective and objective indicators as well as locating such relationship as mutual complementation and mutual verification based on the structuralist approach,it can lays a scientific theoretical foundation for enhancing the scientificity,feasibility and credibility of the evaluation system.
