Preschool education is an important starting point of life.Life is not a 100-meter sprint that only cares about winning at the starting point,but a marathon.Preschool education is the starting stage of lifelong education,is the most important step in a person’s life,the Italian early childhood education scientist Montessori believes that "all early childhood education must be to promote children’s long-term development for the purpose".Preschool children’s education is the most difficult,but also the most easy to be ignored,follow the law of preschool children’s development,explore the potential of preschool children,is very important for individual future growth.Pre-school children refer to "0-before school" children,including two stages,namely "0-3 years old" preschool early children and "3-before school" preschool children.At present,the "3-before school" preschool children have been basically universal pre-school education,and the "0-3 years old" early preschool children mainly rely on family education at home,the early preschool education has not been universal.In general,pre-school education,as an important part of the national education system,is the foundation of basic education,which needs to be strengthened in the long-term and weak link in our education system.Preschool education is the first stage of school education in the national school system.The state and society should also intervene as early as possible to support the education of preschool children in families with many children and poor families,effectively reduce the burden of early education in families,and ensure that every preschool child will not miss the best period of development.Since the beginning of the 21 st century,international conventions have called on States to provide quality or quality education for pre-school children.UNESCO has advocated that quality education is a human right and that all people have access to quality education.At the regional level,it is reflected in the following concepts: "Every preschool child has the opportunity to enjoy quality education","Every child is important",and "pay attention to the development of preschool children’s quality and ability".At the international and regional levels,the right of children to quality education has gradually reached a global consensus.The high-quality development of modern economy and society has promoted the people’s pursuit of high-quality education and the extension of their basic rights.Preschool children’s right to high-quality education is not a "brand new" emerging right,but the new era of preschool children’s right to education in the form of the upgrade.From the perspective of education,its value pursuit is to meet the needs of preschool children’s own development and social development.Preschool education should be based on "preschool children as the center" education,should be based on the basic principles of public welfare,children’s interests maximization,disadvantaged compensation,to meet the needs of children’s personalized development,so that preschool children’s potential in the pre-school to the maximum extent.The right to education is a basic right granted by the Constitution."Fair and quality education" is the basic demand of preschool children as citizens in the new era,which should be elevated to a right.Therefore,the right of preschool children to receive high-quality education,which is enjoyed by "0-enrolled" children,requires the state,society and family to actively provide high-quality learning opportunities,learning conditions and achieve due results,so as to make full preparation for lifelong learning and self-development.Learning is an innate endowment of human beings,and the right to learn is the basic human right of preschool children.As a disadvantaged group,the right to education is an important means to realize the right of preschool children to learn.The realization of the right to learn depends on the family,social environment and resources,and the right of preschool children to receive high-quality education is a right formed on the basis of "ensuring the realization of every preschool child’s right to learn".The "quality" of preschool children’s right to high-quality education is an integral and developmental concept,including the starting point,the process and the whole result of the fair quality.According to the process sequence of preschool children’s education,combined with the nature of learning right,preschool children’s right to high-quality education consists of three sub-rights: the right to high-quality learning opportunities,the right to high-quality learning conditions,and the right to high-quality learning success.The right to high-quality learning opportunities is the primary condition for preschool children to enjoy the right to high-quality education.High-quality learning opportunities directly affect the realization of the right to high-quality learning conditions and the right to learning success.The complete enjoyment of preschool children’s right to high-quality education should not only stay at the starting stage of education,but also continue to promote the realization of the right to high-quality learning conditions in the pre-school education process and the right to learning success at the end of preschool education."Let every child enjoy fair and quality education" from the transformation of educational concept to the transformation of rights discourse,it is urgent to improve the legal system of protection.The state is the obligatory subject of legislation to guarantee preschool children’s right to high-quality education.Only through preschool education legislation can the realization of preschool children’s rights be guaranteed.The legislation of preschool education should start from the basic rights and personal dignity of every preschool child,and achieve full coverage,so that the interests of vulnerable children can be fully protected as soon as possible.After preschool children’s right to high-quality education is guaranteed by legislation,it still needs administrative subjects with legal responsibilities to implement it.Administrative law enforcement of preschool education is an important way to realize the laws and regulations of preschool education.The realization of preschool children’s right to high-quality education needs to establish the administrative law enforcement authority of preschool education,improve the administrative management system of preschool education,improve the administrative supervision system of preschool education and implement the government responsibility system of preschool education."The right without relief is not a right",preschool children’s right to high-quality education,like other basic rights,is also a legal right to claim relief,preschool children’s right to high-quality education and relief has the same important status.Therefore,constructing the system of legislation,administrative law enforcement and relief of preschool children’s right to education of high quality is a major issue facing at present.
