| Encouraging to develop “inclusive preschool education” is not only the development trend and value orientation of preschool education institutions that our country would guide private capital to set up,but also the development principle which is explicitly stipulated in the legislation of Preschool Education Law.While public opinions on the nature standing of “inclusive private preschool education” are divergent.The purpose of this paper is to define the nature standing of inclusive private preschool education institutions,so that all kinds of chaos in the practice of preschool education can be solved by the analysis of laws and regulations,as well as the definition of legal theories.This paper mainly includes four chapters.The first chapter introduces the overview of inclusive private preschool education institutions.Based on the present laws,departmental rules and education policies,combined with the theoretical research of academic experts and scholars,this paper analyzes the connotation of inclusive preschool education.Comparing "inclusive education" with "selective education","compulsory education" and other different types of education,the characteristics of inclusive private preschool education are due to concluded.The second chapter elaborates the practical problems caused by the vague definition of inclusive private preschool education.After the reformulation of non-governmental education promotion law,private education in China is faced with the choice of profit and non-profit,same as the situation of the preschool education organizers.From the perspective of education institutions,lack of clear nature standing leads people to equate "non-profit" and "inclusive" in concept so that the preschool education organizers feel difficult to obtain financial support from the government.From the perspective of educational management department,private preschool education institutions can not get the same education funding subsidies as public institutions due to the lack of legislative authority.In brief,inclusive private education institutions are in management difficulties that its running-school level and teaching quality can not be guaranteed.In addition,inclusive private education institutions are funded by social capital,and the supervision of education management departments is far lower than that of public preschool education institutions,which makes it difficult to carry out effective supervision and leads to chaos in preschool education industry.Combined with the previous definition of the concept and characteristics,the third chapter put forward the nature standing of inclusive private preschool education institutions in three dimensions: basic nature,basic value and basic orientation.First,according to the basic principles of developing preschool education in China and the legislative spirit of the "preschool education law(Draft)",inclusive private preschool education institutions take the public welfare attribute as its basic nature,instead of taking "for-profit" and "non-profit" as the identification criteria,it can also provide inclusive preschool education services and obtain corresponding financial support.Secondly,when analyzing the nature standing of inclusive private preschool education institutions,we need to make sure that it conform to the basic value of education equity.It is reflected in the inclusive preschool education institutions which can provide quality assurance of education services,and protect the disadvantaged groups’ access to education opportunities.Third,inclusive private preschool education institutions are defined as quasi basic public services.Therefore,it is necessary to adhere to the government led,market participation,balance the investment in education funds between inclusive private education institutions and public education institutions,and increase education financial expenditure in areas with backward educational resources.In the meantime,we should make clear the responsibility of government supervision and strictly supervise the teaching level and quality.The forth chapter puts forward the legal protection mechanism and legislative suggestions of inclusive preschool education.The promulgation of "preschool education law(Draft)" symbolizes a new era of legal management of preschool education in China.However,it is not enough to regulate the educational behavior,improve the educational level and encourage the sustainable development of private preschool education only by one law.Constructing the legal guarantee mechanism of preschool education from three levels including legislation,law enforcement and justice to improve the preschool education system.In addition,it is in the stage of soliciting opinions on “preschool education law(Draft)”for now,this paper puts forward the corresponding legislative suggestions based on the previous theoretical research according to the problems to be solved in educational practice,in order to provide a modest force for the legislation of preschool education. |
