Preschool education is closely related to thousands of families and children and it has always been highly valued in China.In the report of the 19 th National Congress of the Communist Party of China,the requirements and goals of“running preschool education and making every child enjoy fair and quality education”were also proposed.It is currently the fastest growing in the education system in China,but it is also one of the weakest parts.Because preschool children are physically and psychologically immature and vulnerable,they need more protection and attention.However,in terms of legislation,China is seriously lagging behind and there is a huge legislative gap.In recent years,the frequent "child abuse incidents" and "school bus accidents" have caused countless people to worry about it."It is difficult and expensive to enter the park" has become a problem for thousands of families.In such incidents,many problems exist in the development of preschool education,such as the establishment of kindergartens,the qualifications and quality of employees,the input of government funds,the rights and obligations of guardians and so on,but there is no specific law to solve these problems.Throughout the world,many developed countries have introduced more than one relevant law to guarantee the development of their preschool education and have given great support and attention at the legislative level.Tracing back to the source,the law at the national level has stability and final strength.In order to solve the above problems,better protect children's rights and develop China's preschool education steadily,legislation must be the fundamental path that should be chosen.The study of the legislative issues of preschool education aims to envisage the specific content of the preschool education law through theoretical research and practical experience,in order to standardize existing problems and reduce or avoid the above events.Firstly,this paper starts with the orientation of preschool education in China's education policy and legal system,clarifies the current situation and existing problems of preschool education legislation in China,and analyzes the necessity and feasibility of legislation.After that,in view of the current research on this issue,the theoretical part of the research is relatively lacking.This paper focuses on clarifying the legal basis of the preschool education law,including legislative basis,legislative principles and legislative techniques,and applies these theories to the follow-upproposal.In the third part of the article,the author selects the two countries,the United States and Japan,to sort out their relevant legislation and draw lessons from them for reference.Finally,on the basis of legislative theory and extraterritorial reference,we will make a vision for the specific content of the preschool education law that will be introduced in China in the future,and propose the draft of the preschool education law for reference.
