The Researching For The Public Participation In Chinese Environmental Protection

At present ,there are increasing emphasis being put on Environmental Protection in China .The governmental function of Environmental Protection has been strengthened and the Environmental Protection Bureau is upgraded into Environmental Protection Department. However,the Environmental Protection relying on government solely will not work .It needs the participation of all the public ,which requires legal and institutional means for public participation .What's more, there are many disadvantages and deficiencies for the public participation in Chinese Environmental Protection, which lacks the procedure systematical security .Based on the concept of the procedural value, started from the view of Public Participation and combined with specific practices ,this paper detaily analyses the practical problems and institutional deficiencies in Chinese Public Participation centered with Environmental Assessment and puts up with some concrete improving suggestions.First of all this paper narrates mainly on the basic concepts, basic theory and legislative status concerned with Public Participation. Secondly, After the investigation in and reflection from the five cases concerned with Public Participation in Environmental Protection happened in China recently ,the writer holds the idea that there are various of participation procedural and institutional problems for the Public Participation ,which need an urgent improvement. Thirdly, after analyzing the combination of Public Participation ways and procedures according to the procedural values and ideas, and analyzing the comparison with the relevant experiences in the other countries and the realistic legislation in our country, this paper elaborates, the deficiencies in Chinese Environmental impact assessment system and puts forward some comprehensive proposals from five participative aspects of target, scope, stage, response and so on. Lastly, from the premise of environmental information system and the angle of the final judicial relief, this paper suggests the legal protection for the Public Participation in the Environmental protection.
