Study On The Environmental Justice And Environmental Compensation System

Distributive justice is the primary topic for environmental justice. Environmental justice is to seek the balance between environmental rights and environmental obligations, but not to eliminate and punish the injustice. Environmental justice is not only the content of environmental justice but also the condition of social justice. Environmental injustice is not only threaten the safety of the social justice, but also aggravate social injustice. Harmonious society is the unity of the environmental justice and social justice. In order to achieve the environmental justice, we must establish the environmental compensation system .Only to establish the environmental compensation system, we can realize the harmonious coexistence between human and nature .It is the new requirement for the human moral.Firstly, the thesis presents the origin of problems concerning environmental justice and the exact meaning of environmental justice. The introduction of environmental justice problems were accompanied with American civil rights movement and environmental protection movement, and it's an important category of social justice. Environmental justice means that concerning environment, in laws, regulations, the making and observation and operation of policies, etc., all the citizens, regardless of their race, nationality, income, education and original nationality, should be treated equally and should participate effectively. Based on this meaning, the thesis respectively explores inter-generational and intra-generational environmental justice problems.Secondly, the thesis analyzes the reasons for environmental injustice in five aspects: firstly, the injustice caused by environment's own characteristics; secondly, the injustice caused in the process of policy making and operation; thirdly, environmental injustice caused by market failure; fourthly, environmental injustice caused in the progress of technology application; fifthly, environmental injustice caused by modern consumption patterns.The third part analyzes the basical theory of the environmental justice .The thesis explains the theory in three parts: firstly, Rawls's original position theory; secondly, maximin rule; thirdly, environmental rights theory.Finally, the article introduces the environmental compensation system to solve the problem of the environmental injustice. Firstly, the thesis introduces the basical theory of the environmental compensation; secondly, it introduces the environmental compensation types and environmental compensation principle. At last, the thesis introduces how to solve the environmental injustice.
