Research On Function Of The Environmental Non-governmental Organizations In Building Environmental Rule Of Law

At the 17th National Congress of the CPC, The congress stressed that the basic principle of ruling the country by law will be implemented completely and the construction of the rule of law country will be faster. As we known, the implementation of the rule of law requires a well-developed civil society, or a community to constrain the power of political society, and then keeps the forces of "civil society-community-political society" in balance. In other words, social forces play an important role in making up the government's "invalidation". Similarly, the social forces which involved in environmental protection is also very necessary in the construction of legal system, it has been an important factor in the process of building the rule of law society. Therefore, as the heart of the social forces, the environmental non-governmental organizations will become a booster in the environmental rule of law; also, its functions will become increasingly important. Environmental non-governmental organizations can develop public awareness in environmental protection, ensure the enforcement of environmental law, and monitor the environmental power of government and so on, which are beneficial to the construction of the environmental rule of law. It can be said that the development of environmental non-governmental organizations closely connected the development of environmental law. However, environmental non-governmental organizations do not live in a vacuum. A number of factors will affect the effect of the environmental non-governmental organizations, particularly in its self-building. We have to change the status of environmental non-governmental organizations so that it could get a sustained, rapid and sound development. At that time, the environmental non-governmental organizations will make a real difference in the construction of rule of law.Based on this, at first, the article elaborates the concepts, characteristics, causes and current condition about the environmental non-governmental organizations. Then it introduces the function of environmental non-governmental organizations in constructing environmental rule of law society. The article describes the necessity of environmental non-governmental organizations and explains that the Environmental non-governmental organizations will play an increasingly important role in building the rule of law society. Third, the article analyses the barriers that impact the role played by environmental non-governmental, such as lacking of self-building and lacking the support of the government. At last, the article proposes some measures for the development of environmental non-governmental organizations. In order to make full use of the benefit of environmental non-governmental organizations, the organizations should be more innovatively, because new ideas also can strengthen self-construction. In addition, improve the environmental legal system and give enough supports are all good ways to clear away the obstacles of the environmental non-governmental organizations. Thus, it must be better to speed up the process of building the environmental rule of law.
