Research On Compensation Policy Of Reservoir Resettlement

Water reservoir resettlement is an important part of hydraulic and hydro-power engineering. Whether the Resettlement compensation policy is drafted good or bad has an important role to do well the resettlement, to protect the legal rights of resettlements, and to maintain social harmony and stability in the reservoir area.Based on the analysis of reservoir resettlement compensation policies, the paper proposed some problems in current reservoir resettlement compensation policies as following:the compensation of the right to development on reservoir resettlement for losses caused by "cessation order",the compensation lag issues of reservoir resettlement and so on. In light of this, the paper started qualitative and quantitative analysis research.Firstly, the right to development on reservoir resettlement issues was analyzed, the paper try to explore "cessation order" caused how much impact to the right to development on reservoir resettlement. Proposed the model to compensate the right to development on reservoir resettlement to measure "cessation order" caused definite loss for the right to development on reservoir resettlement.Secondly, based on the background of rising prices, considering the impact in the process of relocation which was caused by the lag issues of compensation on reservoir resettlement. Lag compensation model was established to calculate the rising prices would cause how much to the process of relocation on reservoir resettlement.Based on these, combining these two aspects, the dynamic compensation model for reservoir resettlement was set up.With the example of the Water Control Project Resettlement in Tingzikou instance, applying reservoir resettlement dynamic compensation model, the paper respectively calculated quantitative loss, which was caused by "cessation order" to the right to development and lag issues of compensation on reservoir resettlement. Then basing on dynamic reservoir resettlement compensation model, the paper counts the resettlement dynamic compensation per capita.Finally, in order to effectively protect the legal rights of reservoir resettlement, based on describing the need for improving compensation policy for reservoir resettlement, the paper designed the proposal of building a reservoir resettlement dynamic compensation mechanism. What is more, the objectives, principles and the main content of dynamic compensation mechanism was designed.
