Study On The Implementation Of Punishment On Government Officials In Qing Dynasty

The implementation of punishment on government officials is very important in the political life of Qing dynasty. It plays an irreplaceable role in against criminal officials, rectifying official governance, quieting livehood, easing social contradictions, promoting the economic development and political stability. For a long time, the most researches on the implementation of punishment on government officials over the academic circles, in my opinion, are focus on the legal system. For example, the laws, the types and the contents of punishment on government officials. Though they have involved some procedures of punishment, but there is still some large vacancy on studying the implementation of punishment. Based on summarizing the results of previous researchers, this paper discusses and analyses the implementation of punishment on government officials in Qing dynasty according to the methods of history and correlative legal theory.This paper consists of five parts:The first part is preface. This part is composed of three sections:academic review and the significance of this research; the main contents, key points and difficulties of the paper; the references and research methods. The aim of this part is finding out the logical starting point according to the review about the implementation of punishment, at the same time, declaring the key points, difficulties and basic historical materials.The second part introduces the laws and the specific procedure of punishment on government officials. This chapter expatiates the laws and the specific procedure of punishment on government officials, and this part also unscrambles the texts which are related to punishment on government officials.The third part is the implementation of punishment on government officials in Qing dynasty. It is the key points and difficulties of the paper. This chapter mainly shows the implementation of punishment on government officials by cases. The contents of this part are expatiated by dividing into administrative sanction and penalty. The fourth part analyses the characteristics in the implementation of punishment on government officials in Qing dynasty. This part is expatiated from highly centralized power of punishment, the special influence of royal authority to the punishment on government officials and grade difference.The fifth part is the comments on the implementation of punishment on government officials in Qing dynasty. It consists of positive significance and disadvantages. In this paper, we firstly discuss the positive significance from several respects, such as punish officials, deter educations, rectify official governance, raise efficiency, keep the national machine in operation, quiet live hood, stabilize society and so on. In another side, we also explain the disadvantages and problems from some respects, such as failure to observe the law, no strictness in enforcing the law, refraining from punishing law-breakers, direct interference to punishment on government officials from royal authority and so on.
