QingYang District, as the origin of agriculture of traditional China, has abundant details of culture and colorful intangible cultural heritage. Therefore she enjoys many great appellations, such as'The cradle of Chinese agriculture','The hometown of fragrant sachet'and so on. With regard to intangible cultural heritage, some measures have been adopted earlier by local government and the positive results have been obtained. Many difficulties exist in the process of legal protection due to social factors and self-disadvantages. The main context of this paper is the achievements and difficulties of legal protection in intangible cultural protection.The paper was divided into six parts.The first part introduces the definition and characters of intangible cultural heritage. What is more, some familiar mistakes were clarified in the understanding of the definition. Besides, international measures of legal protection in intangible cultural heritage were formulated and the differences between them were compared.The second part summarizes the successful experiences in the legal protection of intangible cultural heritage, including legislative protections, governmental actions, applications of heritage items, attempt of industrialization, institutions establishment and efficient working mechanisms.The third part analyzes the difficulties which should be coped with during the process of executing the law. The traditional cultural foundation was corroded by modern craft, such as'the package without spicery','the paper no shape'and'the framework no simulacrum'and so on. Other hand, many social factors hinder the development of intangible culture, for instance, legal deficiencies, population flow and difficulty to the defense of the rights. The fourth part attempts to solve the mentioned problems above. The plan will be remarked from six aspects, including improvement of legal guarantee, development of industrialization and relevant aspects, combination cultural inheritance and industrial development, popularization of folk art, change of protective way ( from the cultural relics protection to overall protection ).The fifth part points out several theories about the protection of intangible cultural heritage in QingYang District. The focus is to argue the valuable foundation of the actions and the aim of governmental model. Besides, the relationship between intangible cultural heritage and national soft power was discussed.The sixth part summarizes all of points in this paper, namely, during the process of the protection of intangible cultural heritage, human-orientation should be emphasized, and reality and history should be respected, especially reality.
