On The Legislative Thought In Guan Zi And The Practical Significance To The Modern Society

Guan Zhong is a famous politician and thinker in Pre-Qin dynasty. Modern scholars generally believe the book of Guan Zi is written in the name of Guan Zhong by ancient scholars which gathered in Jixia School.As far as its contents are concerned, Guan Zi is an encyclopedia including profound thoughts of economy, law, politics, military, science and technology and so on. Among all these thoughts, the law thought is most prominent. The jurisprudence Guan Zi had made such as the creation of law, the quality and function of law, the institution and enforcement of law, had exeeeded others books at that time.The thought of building a country ruled by law was first brought forward by Guan Zi and we still say it today. Through the discussion of its law thoughts, we can have a general view of the ideology of the book.The legislative thought is a part of great consequence in the ideology on "rule of law" in Guan Zi.In the book, a series of important issues on the basic principles of the legislation are elaborated roundly, such as legislation should obey the order of nature and people's preferences, legislation should follow the trend of times and respect the custom, legislation should keep the balance between strictness and looseness, the law should be public and transparent and so on. Despite the historical limitation, the legislative thought of Guan Zi takes on eternal logos and has many references to the modern society.For years, scholars study the legal thoughts of Guan Zi in many aspects. Some specialize in features in its law system; some argue its law concepts;some analyze its differences from Jin ideology system and Qin ideology system; some study law traits in establishment and implement; some check differences between law and other social and cultural relations. There are, however, few articles concerning legislative thought comprehensively. All these affect people's understanding of law thoughts in Pre-Qin dynasty. For this reason, on the basis of collecting data, considering and drawing on the experience of related studies, using historical, dialectical, comparative and analytical methods, this article tries to uncover the legislative thoughts of Guan Zi to the academic circles.The research on the legislative thought in Guan Zi has the great significance to the legal system construction in the modern China.Some tradition legal systems and the harmony thought between Tian and human, Li and law, family and country should be absorbed for building a country ruled by law, for building a harmonious society of socialism.Taking Chinese tradition culture as basis, absorbing its marrow and connotation, being related to Chinese present conditions, china will build up the legal system being suitable to itself and eventually the ideal of ruled by law will come true.
