Research On And China's Protection Of Intellectual Property Rights

Agreement on Trade-Related Aspects of Intellectual Property Rights is an international agreement which is of wide aspects, high protection level, powerful protection strength and strong enforcement on the world scale at present. Therefore, it is attached much importance to by all countries and independent customs areas. The agreement on TRIPS marks a new level of the world's protecting of the intellectual property rights.After China's entry into the WTO, our country must comply with the duties stipulated in TRIPS Agreement, namely, the fundamental principles and the minimum standard of protecting the intellectual property rights for the numbers of the WTO. It's necessary to find out the differences between our current intellectual property rights law and TRIPS Agreement and amend the provisions concerned which contradict this agreement. Focusing on legislation and enforcement , this thesis makes a good comparison between the intellectual property rights law of our country and TRIPS Agreement and puts forward the legislative protections after analyzing and studying these differences on protection of intellectual property rights . At the same time, this thesis also takes notice of the difference among various Countries'law protection level and the characteristics that TRIPS Agreement vaguely stipulates some items on purpose. Thus, in my opinion , TRIPS Agreement should be indirectly applied to our country.
