The Studying On The Government Power Under The Background Of Run The Country By Law

On the basis of learning and accepting the Theory of Equilibrium of the Administration Law, we can get enlightenment from the view that the right and obligation relationship between the administration organ and its opposite side are equilibrated in general, which is raised from the Theory of Equilibrium: to consider the government should be equal with the masses, and so does the government power and the masses rights, which is relevant to the intrinsic request of the current policy that is carried out with great effect in our country called Run The Country By Law. In China, both the relative inequality between the government and the masses before law and the relative imbalance between the government power and the masses rights are still exist in a certain range. This is because, the fact carrying out the Run The Country By Law can solve the problem of the relative equilibrium between the government power and masses rights, however, it bounds a lot in real practice, especially could be restricted by China's historic and cultural customs, the legal tradition, the current policies and other aspects. And during the process of carrying out Run the Country By Law, it also lacks the effective interaction between the government and the masses, and the mainly reason for this problem is that the masses are lacking of the correct understanding of the government power. So only from the Theory of Equilibrium, under the circumstance of ruling by law, insisting the equality between the government and the masses, the equilibrium between the government power and the masses rights, can we realize that the government power itself is neither far from the masses or above them nor completely unreliable. With regard to the government power, it should be restricted reasonable, as much as equally treated and the authority of its legal action also should be respected, which helps carry out the Run the Country By Law smoothly, is in the interest of the government power's effective elaboration and serving people, and helps guarantee the masses rights.
