A Research On Perfecting Legal System Of Petroleum Resources In China

The main idea of this thesis is how to perfect the present Chinese legal system of petroleum industry, so as to reasonably exploit the precious petroleum resources under complete regulation. In the thesis, the author introduced the unreplaceable role petroleum resources have played in economy, politics, strategy and diplomacy throughout the globe of 21 century. While the distribution of both global and Chinese petroleum resources is in equilibrium and they are exploited unrestrainedly, which resulted in petroleum crisis. By studying all kinds of legal systems of petroleum resources in the developed countries, such as Britain and America, the author found that there are many obvious defects and backwards in the existing regulations of Chinese petroleum industry. This suggested that China should take strong action to revise present regulation of petroleum resources and, little by little, set up a comprehensive legal system of petroleum, which is leaded by "Petroleum Law ". It is certain that during this reformation scheme of petroleum legal system, enacting Petroleum Law is undoubtedly the most important step. The author, in the thesis, explained the necessity and urgency to enact "Petroleum Law" and elaborately demonstrated its regulation objective, basic legal institution and framework structure. Among the introduction to the basic legal institution, the author put forward relatively complete systems, including managing system of oil and gas resources, contract system of petroleum and special fund system of oil and gas exploitation etc..
