Analysis On Villagers' Autonomy Legal System

Over ten years have passed since the organic Law of Villagers' Committee was issued, great advances have been made in the construction of Chinese villagers autonomous legal system. However, more profound questions begin to appear with the further step of construction work, and these will become the restrictions of it's development in view of the facts, I analyze the villagers autonomous legal system in this thesis and try to find out the law of its development.As the specific connotation of the villagers' autonomy reflects the division of power of the nation and the society ,in the first part of this thesis, I will define the villagers' autonomy, namely, it is not political autonomy, but the people's autonomy in the basic social life. In the second part, I look back on the long history of the villagers' autonomy in our country, and divide it into three forms as: government by squires, people's commune and villagers' autonomy according to the time and the different characters. When expounding the villagers' autonomy I compare it with other forms of autonomy and define the present villagers' autonomy as the modern democratic legal autonomy. The third part introduces the current situation and construction of the legal system of the villagers' autonomy. First, it is necessary to make reference to the static construction as we regard the villagers' autonomy as a legal system and make an analysis of it. Second, this part foreshadows the focal part of this article——part4. In the forth part, I probe deeply into the dynamic operating process of the villagers' autonomy. The four essential elements which restrain the development of the villagers'autonomy are economy, various interior forces government and village party branches. They have its own mechanisms. They affect each other and form the legal system of villagers' autonomy whose balance and changes determine the development of the villagers' self-government. And this complicated inherit mechanism also lead to different results in the villagers autonomous legal construction. However, there are still regulations to go by. On the one hand, productive forces still plays a decisive part in the villagers autonomous legal system which belongs to the superstructure, so we must devote our major efforts to developing productive forces. On the other hand, we must realize that the construction work is a long-term task and must correctly handle different relations during this course. The last part presents the significance of the construction work and decides the right direction of the villagers autonomous legal system and mentions the problems that we must pay special attention to in the light of its developing rules. The questions are:1)perfect legal systems;2)Improve government's intervening quality;3)Improve macrostructure conditions of the villagers autonomous legal system.I expect the above-mentioned measures can propel Chinese villagers' autonomouslegal system forward.
