The Research On Issues Related To The Laws Of The Telecommunications Service Trade Of China

As required by WTO China Government has committed to open the public transmission networks and basic telecom services to the outside world at the length. However, because of the prematurity of the juristical environment and management systems many aspects of China Telecom Industry do not meet the requirements of WTO. The author holds that problems CTI faces with cannot be solved simply by institution reform and improvement of management CTI urgently needs a law of telecommunications.After studies on Appendixes on telecommunications in the 'GENERAL AGREEMENT ON SERVICE TRADE' of WTO and 'REFERENCE ON THE CODE OF TELECOM REGULATION' of WTO, the author makes reference to the 'ACTS ON TELECOMMUNICATION REGULATION OF PEOPLE' S REPUBLIC OF CHINA' that have been enacted and gives an overall analysis on the actual conditions and major problems of CTI for the present. And furthermore the author produces the legislation conception and basic framework of the future LAW OF TELECOMMUNICATIONS of China and hopes to propel the legal construction of CTI with this thesis.
