The Legal Protection Of World Natural Heritage Wulingyuan

Wulingyuan Scenic Spot is being confronted with the danger of being canceled from "The World Heritage" because of human factors, such as poor protection, undue development and illegal construction, etc after it was listed into The World in September 2000; the first local regulation on protection of natural heritage in China, adopted by the Standing Committee of People's Congress of Hunan Province, Regulation on Protection of Natural Heritage Wulingyuan in Hunan Province. However, the operation of the Regulation isn't very ideal as imperfection itself, conditions of legal system and so on. The problem of legal protection, therefore, is crucial to the administration of heritage. Academic researches on the protection of natural and cultural heritage pay more close attentions on general principles and on less specific resolutions, specially model of development and protection in district although there is a tend of internationalization and legal system on the protection of natural heritage in China, and external and internal researchers have many studies about the protection and administration of heritage. This article, in positivist jurisprudence perspective and adhere to the principle of authenticity and integrity, sustained development, Prevention as the principal thing and international cooperation, discusses the necessity of, for local government, complying with Convention on Protection of World Cultural and Natural Heritage and performing international obligations. This article probes into the resolutions of the legal protection of natural heritage in China citing an example of World Natural Heritage Wulingyuna.
