| The conception of world heritage has been established in Convention Concerning the Protection of World Cultural and Natural Heritage by the United Nations Educational, Scientific, and Cultural Organization in 1972, which is of great importance for the protection of world heritage for human beings as a whole. Every country has been active to declare world heritage and taking various measures to protect relevant resources in its own country since the establishment of this treaty. Theories of world heritage have been developed continuously while the protection of world heritage has become a cause for the entire globe. China is a country of rich world heritage, but there are numerous problems in the procedure of protection work; it is the existing problems in our law system of world heritage protection that cause the most concern among those questions. It is argued in this thesis that without the completeness of legal regulations, it is impossible to fulfill the role of law in the protection of world heritage. As a result, it has become an important issue for us to synthesize the present protection and the characteristics of world heritage in China, to set up and complete the law system for world heritage protection and proceed sustainable development by the way of protecting, making use of and coordinating.Taking the brief introduction of the conception, categorization, features and value, etc of world heritage as a basis, this thesis makes a thorough clear-up of the international law system of world heritage protection and our domestic laws of world heritage protection, by using the methods of deduction and induction, to analyze profoundly the legal regulations of protection in our country, from which the reasons for the existence of so many problems would be found out. It will also discuss the successful experience of foreign countries' protection law system and what we can learn from their experience, finally to propose some practical suggestion for our country. It is concluded that in order to realize the sustainable development of world heritage protection in our country and to make use of world heritage in a long term, it is necessary to enact special law of world heritage protection and to set up the law system of world heritage protection in our country, to make sure that there is relevant law for the protection of world heritage.The protection of world heritage is an issue of widespread influence and concerning large areas, it can't be performed through a certain researching method or some knowledge of a subject. Consequently, by analyzing historically and comparatively, this thesis would make a profound anatomy of the protection law of world heritage, hoping that the discussion in this article could cause further research on the study of completeness of the protection law of world heritage in our country. |
