| By the end of the 20th century, the long non-litigation era in the domain of administration of higher learning institutions of our country reached its end and growing attention is drawn to the rule of law in this area. To accelerate the progress of the rule of law in higher learning institution administration is not only the basis of improving rule of law in the whole society, but also a practical necessity for these institutions in carrying out the rule of law in education as well as in dealing with the increasing administrative litigation in the educational area. The tendency that higher learning institution administration goes under judicial review has brought great impact to the theory of our administrative law and its application, and lots of urgent problems resulting from it needs to be resolved. Thus, it is an urgent necessity to study the application and development of the theory of administrative law in the area of higher learning institution administration. In light of this fact, this thesis researches into higher learning institution administration. Firstly, it reviews the evolution of the relationship between the universities and the government, the construction and mode of power in the higher learning institutions, and the system reform of higher learning institution administration in this country. Then, it studies the relevance between government according to law and government according to law in higher learning institutions. Starting from primary points such as the administrative power, the administration subject status, and the legal relation of administrative law of the higher learning institutions, it explains the concept of the rule of law and its value in higher learning institution administration. Then it puts forward the primary requirement of government according to law in higher learning institutions. Basing on the above, the thesis makes a thorough review over the irregularity in higher learning institutions. |
