On The Hearing System Of China's Higher-learning Institutions

With the accelerating process of administering universities according to the law and the enhancement of the consciousness to maintain their own rights, more and more attention are paid to the internal management of universities by the staff and students of higher-learning institutions, even by the whole society. Universities as managers have such problems as the lack of procedures in the management, so it is necessary to establish the internal management system of hearing to legalize and democratize the university management. In the recent years, many problems still remain in the hearing system of university management of our country, such as the narrow scope of hearing, the weakness of the legislation of the university management system of hearing, the imperfect hearing procedure rules of the unified national university management. Therefore, it is necessary to explore them theoretically in depth. Comparative and inductive methods, literature methodology, interpretation and sociology, are used in this paper, which is divided into four chapters.The first chapter mainly introduces the theoretical and practical significance of this research, gives a summary on the subject of the research both at home and abroad, proposes new approaches of thinking for the construction of the hearing system of university management, and adds new contents to the university legal development, so that the core rights and interests of the staff and students can be better maintained and safeguarded. The second chapter presents the meaning and the legal principles of the hearing system of university management, the sources of the legal hearing procedure of our country, and expounds the shortcomings of the current situations. The third chapter analyzes the necessity and feasibility of establishing the management hearing system in higher-learning institutions, including the current relevant laws and regulations, the legal rights of staff and students, and the advanced experiences abroad. The forth chapter deals with the construction of the hearing system in the university management. By proposing the ideas of university management system of hearing and clearing the principle of hearing, the range of hearing, the subject of hearing, and the procedure of hearing, and by expediting relief way, the staff and students can play a more positive and active role in strengthening the democratic management and system construction.With the development of China's democratization and legalization and the deepening of the innovation of the university management, the hearing system of university management will be strengthened and improved. State education departments are expected in the near future to work out a unified, consistent hearing system of university management in the light of China's national conditions, universal the significance of the internal management system of hearing so as to safeguard the lawful rights and interests of staff and students, and to ensure the internal management of justice, democracy and science.
