As a flexible employment form and non-standard labor relation, under the guidance and with the support of the government, labor dispatching has been assuming the historical responsibility of furthering personnel system reform, advancing enterprise competitiveness, promote labor mobility between urban and rural areas and promote employment in the past two to three decades. Nevertheless, labor dispatching has been utilized by some illegal labor dispatching organizations and employers as a tool of damaging employee rights and pursuing the minimum enterprise cost. Hence it receives both positive and negative evaluations from the academic circle, the practitioners and the work unions of different levels. Labor dispatching in China experienced the initial stage of dispatching by foreign invested enterprises, the preliminary developing stage of promoting employment and labor mobility between urban and rural areas, and the rapid developing stage after the issue of Labor Contract Law.Along with the development of social labor dispatching industry in China, labor dispatching of the institutions of higher learning in Shanghai experienced the different stages of dispatched staff as temporary employees, personnel agency and labor dispatching. After the implementation of Labor Contract Law, labor dispatching in Shanghai's institutions of higher learning gains increasing recognition and utilization. Researching the current employment situation of the labor dispatching of some of the institutions of higher learning in Shanghai and the working situation of the dispatched staff of S college, this study analyzes the main reasons for the implementation of labor dispatching by institutions of higher learning and the inadequacy of the dispatched staff management in institutions of higher learning, such as the need to further standardize the labor dispatching, the inefficacy of dispatched staff management compared with the permanent staff management, the comparatively low income, the lack of sense of belonging, the feeling of unfairness, the tardiness of the career capability development. Meanwhile, the new type of identity management caused by the large amount of dispatched staff exerts unfavorable influence on the employment system of institutions of higher learning. The labor dispatching enterprises cooperating with institutions of higher learning do not fully exert the effect and responsibility of employees; the dispatched staff do not fully understand and recognize the form of labor dispatching, etc.Targeting at the above investigation, this article puts forward suggestions for the government from the perspectives of macro government management, the management by institutions of higher learning, the labor dispatching company and the employees. The suggestions include:the government should further perfect the laws and regulations, gradually cancel the permanent enrollment of the institutions of higher learning and exerts the coordinating role of the responsible education department; the labor dispatching organizations should further standardize the operation procedure, strengthen employer management and organize relative training; the employee should know and understand the relationship and feature regarding labor dispatching laws, understand the condition of the labor dispatching enterprise and the institutions of higher learning, communicate effectively with them, make career plans and join the trade union in the earliest possible time to grasp the rights maintaining tool; institutions of higher learning should reflect upon the form of labor dispatching, rationally meditate upon the advantages and disadvantages of labor dispatching, accurately evaluate and utilize labor dispatching, specify the working procedures with the labor dispatching company within the legal frame, proactively communicate and cooperate, emphasize and exert the enthusiasm of the dispatched staff so that labor dispatching can practically play an active role in furthering the personnel system reform and promote the development of institutions of higher learning.
