The Situation Of Legal Consciousness Of Citizens In The Area Of Jinzhou And The Analysis Of Its Reasons

In this thesis, citizens in the area of Jinzhou are taken as the study object and the situation of the legal consciousness of citizens in Jingzhou and the reasons are studied in the thesis. Legal consciousness is a special social consciousness system, is a subjective grasping manner of a social subject for laws and legal phenomena, and is also people's organic integration of psychological factors such as the rationality, feelings and the will of laws. Its content depends on material conditions and political systems. Legal consciousness is an important component of people's quality and has great influences on the execution of laws. Even if we have quite sound and perfect laws and systems, if people have thin legal consciousness, quite good laws and systems will become a mere scrap of paper because they are not abided by. China is a country with its own specific cultural tradition, and the execution of the strategy of ruling the country by law and constructing a socialist country under the rule of law is a great cause that has no parallel in history. And it is bound to form a distinct legal consciousness that adapts to the modern market economy and democratic politics. Therefore case study on problems of the legal consciousness is conducted in the thesis.The author has applied principles of Marxist dialectic materialism and historical material and has adopted methods of questionnaire, analysis and synthesis, the combination of theoretical study with real case research. First, the basic connotation, fundamental structure and the type division of legal consciousness are discussed. Then an analysis on the first-hand materials of citizens' legal consciousness in Jinzhou area is made. Especially, my own distinctive opinions are put forward on conflicts between the traditional legal consciousness and the modern legal consciousness and on problems of the switch from the former to the latter among citizens of Jinzhou area. Viewing from the problems in five aspects (the basic values of citizens in Jinzhou area, their knowledge, impression or evaluation on laws, their using legal means in their daily life, the knowledge of related institutions, and their evaluation on whether our laws accord with citizens' intentions), the level of citizens' legal consciousness in Jinzhou area is to be heightened. The situation of contradictions and features of transitions are expressed. That is, traditional ideas are interweaving with modern consciousness, positive attitudes coexist with negative ones, and consciousness of legal rights is weaker than legal practical consciousness. In the thesis, emphasis is put on reasons of the situation of citizens' legal consciousness. There are direct reasons of the underdeveloped commodity economy, factors of the history and the environment and the maladjustment of legal life. And there are also influences of traditional legal consciousness. The influences include ideas of putting more emphasis on the rule of persons and neglecting laws, ideas of putting more emphasis on morality and less emphasis on interests, putting more emphasis on punishment and less emphasis on citizens, and putting more emphasis on officials and less emphasis on citizens. Effective ways are put forward for the cultivation of citizens' legal consciousness in Jinzhou area. Finally, an active conclusion is arrived at, that is, the key to the modernization of the Chinese legal system lies in the construction of citizens' modern legal consciousness.
