Legislative Research On Renewable Energy In Our Country

The contravention between economy development and energy consume, environment pollution is even severe. Renewable energy will solve these problems totally and ultimately. Lawmaking is the most effective measure which can promote the development of renewable energy. And theory is necessary when a law is constituted and implemented. According to the situation of legislative research of renewable energy in our country, the author clarified the purpose of this article: definitudes the legal feature of renewable energy, made the legislative purpose more clearly, constructed the institutional system of renewable energy. The conception of renewable energy is clear, but.the legal feature of it has not been discussed yet in law circle. In this article, the author definitude the legal feature of renewable energy: commons, continuance and instability. Its legal feature decides the legislative idea and purpose, The theory of sustainable development is the legislative idea; legislative purpose is constructed by the initial purpose, intermediate purpose and final purpose. Legislative principle is the representation of purpose, it includes several principles: the principle of benefit balance, the principle of integration, and the principle of obligedness and inspiritment. The institutional system of renewable energy in our country should base on the national situation, consider the theory of sustainable development and legislative principle of it. The constitution of the law can be reduced to four parts: general purpose of the country, economical inspiriting institution, the institution of market deploitation and research&development. Finally it analyzes theconsummation of institution system, mainly involved System Benefits Charge, Renewable Portfolio Standard and Green Price.
