August 27, 2007, AQSIQ promulgated the "Regulation on Food recall" which symbolized the formal establishment of China's food recall system. "The People's Republic of China Food Safety Law" which was promulgated on June 1, 2009 made food recall as an important system on food safety. As the last line of defense of food safety, food recall plays a very important role on protecting consumer's interests, maintaining social stability and ensuring the healthy development of China's food industry. However, compared to developed countries which have established complete food recall system, China's food recall system needs improvement.This paper is divided into three parts. Starting from the basic theory, the first part focuses on the development of food recall system and analyses the difference between food recall and related concepts. The second part of the article combines the food recall systems in the developed countries to introduce the development of Chinese food recall and make a detailed analysis of China food recall system characteristics such as legal support, monitor mode, the recall's classification, recall's program, legal responsibilities by use of comparative analysis. Then based on these analyses, this article highlight China's food recall system defects. On this basis, the paper finally discusses the necessity of food recall system improvement and further proposes the principles of the improvement of food recall. Last, the paper puts forward legislative proposals about the food safety mode, the improvement supporting food recall system and corporate role in food recall.
