Legislation Of China Urban Public Transport

With the continuous development of the national economy, the publics are becoming more and more concerned with urban public transport which is closely related to people's travel ,work ,daily life and other aspects. Because urban public transport is a major livelihood issue, the opening of a bus line, and the rise in bus fares would give rise to public serious concern every time. Although Chinese urban public transport development has made significant progress, they also appeared to be disordered. Its development policies and development speed vary from different regions, the construction of laws and regulations still have a long way to go, and there are no national laws and regulations of urban public transport. In the new century, with accelerating urbanization, growing urban population, the trend of an integral of urban and rural has become more and more obvious and the problems of urban public transport are increasingly prominent. And improving legal system of urban public transport is the basic guarantee for the healthy development of that. This paper will study the legislation of China's urban public transport administrative regulations in depth.First, Through present situation of the city public transportation development, for understanding the pressure on urban public transport facilities with the current utility of urban public transportation, China's public transport legal with the current utility of urban public transportation development .China's urban public transport's problems are: incomplete public transport regulatory system ;relatively low legislative level in urban public transport system of legal norms ;desiring attention and implementation in making bus a strategic priority ;bottlenecks in public transport development ;a long way in the transportation integral of urban and rural ,so urban and rural dual structure has led to a severe imbalance in the development of public transport; inexperienced in rail traffic management ;unclear rights and obligations cause plenty legal disputes between drivers, conductors belonging to urban public transport bus companies and passengers ;a lack of clarity about urban public transport position.Secondly, we discuss the necessity of strengthening the legal system of urban public transport. Strengthening the legal construction of urban public transport is required for building and improving the legal system for socialism with Chinese characteristics; Strengthening the construction of urban public transport regulatory system is a necessary demand for promoting the concept of running the country according to law in the transport sector; strengthening the regulations construction of urban public transport is of great necessity to achieve great development in urban traffic and transport .Thirdly, we have a certain understanding to public transport legislation on foreign cities. Currently, the following foreign experience are worth using for reference: the subsidies of public transport,to help the urban vulnerable groups,advocating fair and reasonable market competition in urban public transportation areas,putting emphasis on public transportation planning.Fourth,China's urban public transport legislation should make efforts to solve the following problems:(a)to establish a nationwide urban public transport regulations; (b) to clarity the scope of urban public transport; (c)to define the principle that the urban public transport legislation should follow; (d)to establish bus priority system; (e) to establish franchise system;(f) to establish financial subsidy mechanism on condition that urban public transport at low price; (g)to clear public transport operator's rights and obligations; (h) to break the urban-rural dual structure, and gradually make the rural and urban integration; (i) to make great effort to develop rail transit and urban rapid bus; (j) to rationalize public transport management system.
