The Legal Thought Over The Re-crime Of The Subjects Of Community Correction

As the rules of the"Notice of the experimental works to develop the social community corrections"promulgated by Supreme Court, the Supreme Procurator, the Police Department and the Justice Department in July of 2003 states that the community corrections means that it will meet the conditions of the offenders placed in community corrections within the community, by special state organs, in the relevant social groups and civil society organizations and volunteers with the assistance of the decision or determination within the period specified, correct the criminal acts of awareness and bad habits and to promote their return to society the implementation of activities of non-custodial sentence. So the author considers that the major reasons of the re-crime of the community corrections would be the subjective and objective ones which are the insider ones that is the guide of the corrections and the mistakes triggered of the action model and the outsider ones that is the catalysis effects over the corrections. In practices, the corrections are to make the crimes back to the society with the certain active effluences. However, the various laws and the regulations and relative systems are not prefect and many problems in the experimental stage that we should strengthen the controls over the re-crimes which causes the unstable elements and the weaker power of the correction than the prison. All of this effected over the coherence and enjoyment of the public to the system of social corrections which determine the achievements of the projects. Therefore, we should amend the legal system and perfect the social management and enforce the education and the corrections to promote the prisoner back to society successfully and to prevent and reduce the re-crimes to achieve the social target at best. But in practices, we also picked up that as the previous disadvantages and the uncertain qualities, the controllers are leaking of the guarantee of the legal system and the measures of the rules and regulations which cause the re-crimes. As the overall of the promotions and the reductions and the preventions of the re-crimes, the most necessary thing should be the perfects and amends in legislations.
