The Establishment Of Index Of The Rule Of Law In China

The Foreign Wealth Report which is compiled by World Bank in 2005 raised a concept of Index of the Rule of law. Since then, this concept has caught the attention of Chinese which enables their aspiration to make an evaluation objectively, directly and scientifically on legal system construction. Index of the Rule of Law evaluates systematically on the current situation of assigned districts, which enables the abstract things to be concrete and digital and promotes the development of legal system construction effectively.With the Brings Principle, this article at first analyses the concept and the constructing meaning of Index of the Rule of law, then introduces the good points of it compared to traditional evaluation method. Secondly, it describes the current situation of Index of the Rule of law in China, then make a systemic introduction on the emerging of Yuhang Index of the Rule of Law, as well as the system design and prominent features. The core of this article lies in the third part, which shows the local thoughts on Index of the Rule of Law. Based on the systematically analysed Yuhang. Index of the Rule of Law, the writer pursuits an evaluation system that proper to constitutional quantification. Discussion is concerned with Principal Body for Evaluation, Rules of Assessment Design and Legislative Proposals, the writer tries to establish the miniature of localized Index of the Rule of Law. The last part is about the enlightenment of localized legal system construction in China. Index of the Rule of Law is figurative, especially in current situation of China, it cannot evaluate the whole circumstances on constitutional development. Though it is burdensome to make the Index of the Rule of Law localized, the introduction of it is still meaningful according to the writer.In conclusion, based on the Brings Principle which has been previously discussed, the writer figures that the occurrence and introduction of Index of the Rule of Law is a product of legal development, which is in line with the epoch feature. Therefore, we should take the essence, discard the dregs so that the localization of Index of the Rule of Law can be realized.
