On The Construction Of The Quantitative Index System Of The Rule Of Law In Mainland China

The World Bank released a report called WHERE IS THE WEALTH OF NATIONS in 2005. The report formally proposed a new concept of "the rule of law index" in which fixed thinking of rule of law was changed. Quantitative research method is introduced to the evaluation to rule of law. Thereafter Hongkong, Yuhang and some other places in China have started this practice. It promote the development pace of the rule of law very fruitful to move forward.This paper introduced progress and advantage of quantification of the rule of law compared with the traditional rule of law, and analyze the experiences and defects in the practice of international law quantization. Finally it put forward the necessity of building the localization quantization index system of the rule of law. The second chapter describes the background of building quantization index system of rule of law and the basic Chinese principle it should follow. In the third and the fourth chapter,this study creatively constructs a set of the quantization index system of rule of law. It requires not only referring to the domestic and foreign similar research but also matching with the local environment of the rule of law. The purpose is to use scientific algorithm to measure development situation of rule of law accurately in various regions. Finally, the paper bases on theory and practical experience of the existing similar research and put forward a series of questions of this study may exist include error in the process of digitization of abstract conception, the objectivity problem of the subject and data acquisition error. After detailed analysis, the paper put forward a systematic construction scheme for the system of China mainland quantitative index of the rule of law which stands to reason and is effective.In the final conclusion, the author emphasizes importance of localization of quantitative evaluation of the rule of law. It is necessary to construct a unified quantitative evaluation system in the national scope to provide a comparative platform for regional development of rule of law from transverse and longitudinal aspects. The ultimate purpose is to serve the development of the rule of law of country and social most efficiently.
