Nowadays, one of those hot discussed topics among sociologists and jurists is how to regulate family violence. The primary coverage of this essay is to represent the history of anti-domestic violence in England, and to introduce the legislations, judicial procedures and reform measures of England in this field. This essay can be divided into four parts.This first part is about husband's right to punish his wife. In this part, the author first introduces the background of the husband's right of punishment, then analyzes woman's family status and their suffering from domestic violencebefore and in the modern times. Although there were a few of people argued against this, the English society did not consider it's intolerable. On the contrary, the English people thought husband had the right to do this and it was a reasonable chastisement to their wives.The second part is about as prelude to develop anti-domestic violence law.From the 19th century till the 60s in the 20th century, the status of the married women changed greatly. Some of them began to have a high position in society, and they launched a series of campaigns to fight against family violence. These campaigns included the refuge campaign, the zero tolerance campaign and the"one year rule"campaign, which gave the traditional ideas of English families a big shock and promoted the reform of legislations and policies.The third part is about the legislations reform and the judicial experience concerning anti-domestic violence in the 20th century. The 2oth century witnesses the independence of English women. In this century, domestic violencehad been paid much more attention, and the correlative civil laws had been revised in order to offer relief to those victims of domestic violence. Protection orders and injunctions had been often used, and the applicability of the protection order also expanded. However, there were still some problems in law enforcement. To settle these problems, England found a cooperation system of courts, governments, police offices and social departments, which worked efficiently. The government's attitude against domestic violencelaid the groundwork for the following legal reform.The fourth part is about the new developments of anti-domestic violence. In this part, the author introduces some important points of view concerning the definition and manifestations of family violence. Then the author gives an account of the new developments of anti- family-violence laws, including the promulgating of some slip laws, the improvement of criminal suit system, the revision of children act, and so on.
