In this paper, the author tentatively studied on the legal protection of the employment right of disabled persons by comparative analysis of the Chinese and foreign legal protection system in this regard; based on his personal work experience in Suzhou Disabled Persons Federation, internal Interviews and effective references, he dissected the gains and losses of China's legal protection system of the employment right of disabled persons and finally introduced countermeasures to improve the system from both theoretical and practical considerations.The conclusion drawn by the paper was: Since the reform and opening up, China has preliminarily shaped its own legal protection system of the employment right of disabled persons featured by equal and special protection following the legislative idea that the employment right is the basic human right of disabled persons, which has made significant achievements both on the law and practice levels; but, compared with that of developed countries, it still needs improvement. Hence, the paper boldly proposed introducing a Disabled Persons Employment Act, the draft of which is actually finished (see appendix) and integrating relevant laws and regulations with the Act as a guide wire while improving other relevant legislations and systems.One innovative idea brought by this paper is, a proper monitoring system shall be established for legislating the Disabled Persons Employment Act to pragmatically protect the legal employment right of disabled persons whose capacity for civil conduct is restricted.
