Research On The Right To Migrate

Migrate right has been the citizens'fundamental right under the constitution. Since the 1950s China attached great importance to industrial growth, adopting the policy of industry-oriented agricultural development and the system of segregation between unban and rural areas, which resulted in the practical deprivation of citizens' free migrating right. Based on the research on some relevant problems, in particular the history, necessity under the constitution, subject and classification, this paper discusses the development and relevant regulations from ancient time till present, both at home and internationally, analyzing the origin of the right and arguing that it is of significance and necessity for free migrating right to maintain national unity,' safeguard citizens'fundamental right, develop marketing economy and push forward political and economic reform. Besides, it deals with the problems of transborder migration and government approval, and classifies citizens with free migrating right as follows, such as government organized migration, policy-allowing and practical, and how to exercise the right. In the introduction to the migration subject, it also presents rural worker due to this right by disgusting the origin, essence and the influence on China's economic and social development.Moreover, this paper examines the reform of household register system, holding that free migrating right should be safeguarded under the constitution, which could be introduced to the reform of household register system. Under the constitution, it deals with the severe difficulties in reform and aims to solve the problem of household register system. Based on the classification of central and local governmental measures, the strengths and weaknesses are stressed. In order to push forward reform, promote economic development and maintain stability, some detailed reform measures, including perfecting centralize unity of household register system, residence pass, classified management and step-wise empowerment based on the principles of joint efforts, making overall plan and steady progress, are suggested.
