China's E-commerce Legislation Under The Background Of Economic Globalization

Electronic-Commerce is also defined as Electronic-Business, in many cases, the so-called Electronic-Trade,the paperless trading, Electronic-Transaction, the Internet trading have the similar meaning with Electronic-Commerce. Modern information and technology represented by computer and internet technology make the process of globalization further speed up, especially in the economy globalization,the development of Electronic-Commerce provide platform and impetus for the economy globalization.The concept of economy globalization still vary from person to person in the academia, although different theoretical schools have different views,yet they have arrived at the common sense, International Monetary Fund can be generalized as:globalization makes each country highly combined each other in the whole world through trading, the movement of funds, technology creation, information internet and cultural exchange, every country economy produce interact relationship through the increasing diverse goods and the extensive output of labor force,the movement of international capitals and the more fast and extensive spread of technology.The technology itself always is a double-edged sword, information technology implicates lots of problems after contributing a lot to the global economy, producing great negative impact to the internet environment and the entire human society, which is the same as Electronic-Business promoting the economy on one hand. Electronic-Business brings about enormous force for the economic activity, because it break through the limit of time and space. Making commodities and service resources are combined and allocated in the more off high efficiency and rational way, providing impetus for the development of global economy. On the other hand, the Electronic-Business also brings about many problems, especially under the background of the economic globalization, these problems standout. For instance, it provides opportunity for the lawbreakers who master high technology, making them take advantage of technology penetration to grab commercial secrets, which extremely hinder the normal work of economy, producing enormous potential danger for the economic development. Furthermore, the process of economic globalization objectively bring down the capacity of one nation interfering with economy, the economic trading between different nations and different cultures need a new kind of law system to guarantee, so as to make the commercial activity in different nations and areas work smoothly in the safety environment, giving full play the function of Electronic-Business in the economic globalization.China considered the economic globalization process from reality. Neither blindly optimism should we owned, nor the pessimistic rejection can we give to it because of the hidden trouble during the process of the economic globalization. We should accept both opportunities and challenges and prepare enough to overcome the impact of economic globalization. This article targets on economic globalization social background as well as the special situation of our country, which proposed some suggestions of e-business legislation. It considers opportunities and challenges from economic globalization for the development of our country as well as the far-reaching effects to it, also takes the special situation of our society and economy into consideration. On this basis, it analyses the interaction between economic globalization and the actual condition in our country, also put forward several suggestions for e-business legislation in China.Economic globalization brings extremely challenges to e-business legislation in China. It will take a longer time for the improvement and have a research on the theory and practice of e-business legislation.
