Research On The Legal System Of China's Food Safety

Food is the substantial basis of the living and development for the human to live on. Food safety is a fatal issue connecting with the health of human and national economic and people livelihood. Recently, as the globalization of the economic and expanding of international food commerce, food safety events happened frequently in some countries and areas. With rapid growth of the economic, food safety of china is becoming prominent day by day and have disturbed the development of food industry and social stability. Food safety is an important standard for the quality of the life and legal construction of a country. Most developed countries and international organizations use legal means to ensure food safety as an important measure, and have been constructing effective supervision system and legal system for food safety."Food Safety Law"was implemented in 2009, had made breakthrough progress in the establishment of legal system for China's food safety. But, we still have a long way to seek to a more reasonable legal system. We must recognize clearly that the current legal system has a lot of shortcoming and defects. The food safety supervision exist some problems such as duplicate law enforcement and ambiguity of power and duties, and lack for unity and coordination in management. There is very big gap between China and developed countries. Therefore establishing legal system suitable for China has very important significance both in theory and practice for maintaining social stability and promoting international food commerce.This article proposes the idea of centralized supervision mode through analyzing the current status of supervision framework and legal system for food safety. Mean while, draw lessons from development countries about their advanced experience of food safety supervision. There are four sections in this article. The first section introduces the basic concepts and theories about food safety. It analyze the seriousness of food event and the necessity of supervision on food security. The second section seeks to find the problems in food safety system by analyzing the legislation and law enforcement in China. To consummate Chinese jurisprudence system in scientific, the third section of this paper introduces the legislation and food safety system about some developed countries in detail, such as England, USA and Japanese. The forth section of this article gives some ideas and recommendations for improving Chinese food safety legal system. For food safety legal system, a series of clearly concrete legal institutions are the most important. We need to establish a series of legal institutions for overall supervision of food safety in China, such as food safety standard system, food label system, traceability system and information united publication system.
