After reform and open policy, with the rapid development of China, appeared a new type of labor and employment form-labor dispatch. It's changed the traditional forms of direct hiring employers, labor dispatch institutions establish labor relations who not have working conditions, but companies who have both the working conditions and labor positions don't establish labor relations with employees directly. The traditional labor law and labor relation has been challenged. In resent years, labor dispatch has developed rapidly, but in the specific implementation process, there have been many problems. January 1,2008 began to implement the 'Labor Contract Law', there are norms and restrictions on dispatching, and strict rules on enterprises and dispatch organizations to protect the employees' rights.The rise of oversea labor dispatch is earlier, there is a lot we can learn from them. This paper selects three representative countries:the United States, Japan and Europe, the development and reasons of its dispatch will be analyzed in this paper, two legislative experience could be used in our country.In this paper, I put forward some suggestions with case study, try and explore the risk identification and risk prevention aspects on labor dispatch in a power grad company, decompose labor dispatch into three parts:establish labor relations, maintain labor relations and deliquesce or ending labor relations, and Identification legal risks, and put forward some feasible measures. Practical implementation of existing legislation and in the process of judicial settlement, hope making the labor contract law on dispatching employees principled advocacy provisions into concrete, actionable, with clear responsibilities level, but also making labor and employment of state-owned enterprises more standardized, reasonable employment within the legal framework, provide a good environment for the harmonious and stable development.
