With the reform and opening and the reform of state-owned enterprises start,more and more migrant workers and laid-off workers enter the dispatched workers.Synchronization with the economic development of our country,the development of labor dispatching industry speed and increase the Numbers of dispatched laborers.To regulate the development of labor dispatching industry and protect the rights and interests of the dispatched workers,developed in our country "labor contract law of the People's Republic of China(hereinafter referred to as the" labor contract law ")and the interim provisions on labor dispatch(hereinafter referred to as the "interim provisions" and other laws,regulations and rules,in reality,however,to get different pay in our country's labor dispatching problem is not optimistic.The paper choose the labor dispatching in the research on legal issues of equal pay for equal work entitled to compose,aimed at the status quo of research in our country labor dispatch the equal pay for equal work and its causes,and put forward the perfect our country labor dispatch the equal pay for equal work,in order to realize the protection of right of the dispatched laborer equal pay for equal work,promote the labor dispatch industry better serve the economic development of our country.This is the research purpose and significance of this article.In the process of research,the author generalizes the existing research literature of our country,in order to better on the basis of predecessors' move on,at the same time to our country through analyzing the deficiency of the law.To make a more comprehensive research,the author also compared the outside the main country labor dispatch the equal pay for equal work of mature practice and law,find enlightenment to our country.Finally,through the in-depth research,the author in combination with the current practice in China,the law case and draw lessons from foreign experience perfect the legal system in our country labor dispatch the equal pay for equal work is put forward Suggestions and countermeasures,mainly have the duty to clear staffing firms and accepting units subject status and its specific obligations;Clear "workers" and "equal pay" judgment criteria;Clear and refined in violation of the provisions of "equal pay for equal work" legal responsibility;Perfect the supervision legal system of the administrative authority;Perfecting the right remedy of equal pay for equal work.The author thinks that,to get different pay problems in labor dispatch is not terrible,perhaps in reality hard to implement the principles of labor,but with the continuous improvement of the legal system,labor dispatching implementation of equal pay for equal work.
