Labor dispatch is a unique way of human resource distribution. The top characteristic of labor dispatch is the separation of"employment"and"use". The dispatch organization and the labor reach a labor contract. Then the labor is send to"the use"based on an agreement between the organization and"the use". The labor provides the service under the direction and Supervision of"the use". It's the outcome of social division of labor. In many countries, enterprises adopt labor dispatch more and more in order to adapt to the change of the market and reduce the cost. From the beginning of the 1990s, labor dispatch started developing fast in China.Labor dispatch Challenges the protecting of rights and interests of labors. There are many problems such as discrimination, Lack of training. Unequal pay for equal work between dispatched workers and employees in"the use"often appends. It's a problem of wage discrimination. The issue of equal pay for equal work is clearly written in our labor law. That is a manifestation of social fairness and justice.Labor dispatch was born in the United States. And it's developing in America, Europe, Japan and other countries. In those areas, labor dispatch is used to complete provisional tasks. One task Continue for a short period of time. Foreign government played an important role in safeguarding the rights and interests of dispatched workers.Under China's unique economic, political, juristic and culture background , the characteristics of labor dispatch are quite different from the abroad. By analyzing the reasons for developing labor dispatch in China, it's found that the most of Chinese Enterprises adopt labor dispatch in order to reduce labor cost by the way of unequal pay for equal work between dispatched workers and employees. This is an incorrect understanding and judgment on what's the Advantage of labor dispatch.According to the survey data and cases, it is seen that there are a huge gap between dispatched workers and employees. The problem of unequal pay for equal work exists. It brings a lot of harm to the labors,"the use", the dispatch organization and the society. Then, this paper analyses the reasons for why the dispatched workers are hard to realize the right of equal pay for equal work .At the last part of this paper, some countermeasures on helping dispatched workers realize the rights and interests of equal pay for equal are put forward, so as to make this new human resource distribution can generate its due positive effect in our country.
