| Housing, housing price, especially housing security projects such as low-rent houses have been being the hot topic of general public. With the end of China's welfare housing distribution age and the deep-going of housing reform, there has brought forward many issues and contradictions which did not get government's due attention and effective solution. The conflict between high housing price and low income is daily acute, which makes the populace, especially the low-income groups cannot have their own residence at all. So, housing problems have become one of the toughest social ills. As we all know, our government has not step up to its due responsibilities, therefore, it is necessary to study on how to make effective laws about government duties in low-rent housing projects. Only in that way, the populace's right to adequate housing could be ensured.The study object of this paper is the legislation on government duties in low-rent housing field. This paper first analyses the legislative status and existing problems, and then illustrates the basic theory of"supply administration"as well as related foreign making laws, in the end, it comes up with some suggestions about how to perfect the legislation on government duties in low-rent projects, which emphasizes the responsibility of supply administration.This paper is divided into six parts:The first part introduces the basic concepts of government liability in low-rent projects, with the object limited to legislative studies, and then analyzes them in the history view, dividing into five stages: initial period, actual establishment period, clearly established period, detailed period and legalization period.The second part analyzes the legislative status on government responsibilities in low-rent housing projects, states the system structure and the law content, and briefly estimates the performance as well as problems of current legislations.The third part focuses on the basic theory of government duties in low-rent housing projects, which is oriented to survival rights, supply administration and the idea of law regarding administration.The fourth part briefly examines the foreign laws and their implementation about government responsibilities in low-rent housing projects, including Japan, Singapore, USA and UK.The fifth part puts forward some feasible proposals about how to improve the legislations on government duties in low-rent housing projects, for example, transforming the traditional ideas, establishing the government duties in the projects clearly, strengthening the"payment"duty, perfecting the"permission"duty, improving the supervision and management duty, and building the accountability mechanism.The sixth part makes a brief summary of the whole paper. |
