Research On Extended Producer Responsibility

Fast economy development and stepping up of consuming lever of our country has progressing products so fast that leading to large number and complex solid waste which brought out more pollution and serious damage to our environment.Against the serious problem of waste products, the system of"Extended Producer Responsibility"was proposed by many countries. Extended producer responsibility makes the responsibility of the producer extend to entire life cycle of the products, especially the responsibility of recycle and reuse. And this system works out well on waste products problems.Part one: This part mainly introduces the conception and characteristics of waste product and the solution, mean EPR, of waste product problems, then point out producer should take all the responsibility during the whole life of products, especially the responsibility during the end-life of products,in order to resolve the waste product problems.Part two: This part mainly points out that the extended producer responsibility was the effective countermeasures on resolving the waste problems. Then through analyze the theory of the extended producer responsibility and the practices at home and abroad to provide reasonable basis for implementing the system of extended producer responsibility in our country. Part three: To the increasingly serious problem of waste products, many countries have gradually established the extended producer responsibility regime comprising the pollution preventing responsibility for waste products from source, the responsibility of product's environmental information disclosure and the responsibility of recycling, disposal and reusing of waste products. Then further pointed out the responsibility of recycling, disposal and reusing of waste products is the core of the extended responsibility, and the recycle responsibility is the most important to the resolving of waste problem.Part four: On the basis of analysis of the status quo and the existing system obstacles, of extended producer responsibility in China, in order to solve the problem of waste products, combining with China's basic national conditions, The Extended Producer Responsibility should be implemented by China's administrative enforcement, to require producers to bear the pollution preventing responsibility for waste products from source, the responsibility of product's environmental information disclosure and the responsibility of recycling, disposal and reusing of waste products. Meanwhile, in order to ensure that extended producer responsibility system in China can be implemented, suggest establishing a Unified multi-level system of extended producer responsibility legal system, on the basis of"Circular Economy Promotion Law"and formulating a corresponding single law in accordance with industry, and the local development lay down specific implementation details or implementation of methods. And in order to further specific the content of the Extended Producer Responsibility, the scope of application, recovery mode, recovery target and legal responsibility should be clearly identified, thus to protect the environment and save resources.
