Discussion On The Extended Producer Responsibility Regime In China

December 25,2016,the State Council issued the "Producer responsibility Extension Scheme",the program elaborated on the implementation of the producer responsibility Extension system's overall requirements,scope of responsibility,key tasks and safeguard measures.This shows that the State attaches great importance to the system of producer responsibility extension,has been promoting the implementation of the system development,but the academic community in recent years,the producer responsibility Extension system of theoretical research is still very limited,and the scope of the implementation of the system is not comprehensive discussion.Therefore,it is necessary to discuss the content of the extended producer responsibility system and its application to the new era.The first part of this paper is a brief overview of the extended system of producer responsibility.First of all,the author expounds The concept connotation of producer,producer responsibility extension and producer responsibility extension system,secondly,it briefly describes the historical evolution of producer responsibility extension system,and it is the exploration and summary of the theoretical basis of the extension of producer responsibility,including product life cycle theory,externality internalization theory,The theory of circular economy and the theory of corporate social responsibility,and finally the practical meaning of the extension system of producer responsibility is analyzed.The second part of this paper is to think about the present situation and insufficiency of the extension system of producer responsibility in China.The present situation of construction is based on the present situation of legislation and its implementation.This paper introduces the legislative situation from the legislative background and the existing legal basis in two aspects,and concretely explains the present situation of the system implementation from the object,mode and organization mode of the extension system of producer responsibility in China.There are some problems in the system,such as imperfect legislation system of waste recycling,unclear responsibility scope,imperfect supervision mechanism,imperfect public participation mechanism,low awareness of public and enterprise environmental protection and insufficient participation enthusiasm.The third part of this paper is a comparative study of foreign producer responsibility extension system.The first is the introduction of foreign producer responsibility extension system,including Germany,the United States,Japan three countries.The second is the summary of the revelation of the extension system of foreign producer responsibility to China,namely: the enterprise combined with the waste recycling,local legislation in combination with local characteristics,the government plays a leading role in the implementation of the system.The forth part of this paper is the author of the second part of the problems raised in the third part of the foreign producer responsibility Extension system experience summary,to reflect and put forward perfect suggestions.The specific suggestions are as follows: Firstly,perfecting the legislation system of waste recycling and utilization,which includes classifying legislation according to the property of waste,and establishing and perfecting relevant supporting system.Secondly,it is clear the obligation disposition of the related subject,in which the government,producer,seller,Consumer,Special recovery and processing institutions,such as the main body to carry out a clear responsibility for the allocation of responsibilities.Third,improve the supervision and management system,including the full play of the government supervision functions and the integrity of the social supervision system.Finally,we should improve the public participation mechanism and propose ways and means to clarify public participation,Improve the legal safeguard measures and the public awareness of environmental protection.
