National view has become a crucial problem of the political philosophy and political lives. In this day and age, many people begin to review the national state and democracy which has been seen as the best choice of the human political system form. We have to discuss and answer the question: How to limit the power of state, how to protect the rights and whether the democracy is the best choice or have-to choice.Friedrich August Von Hayek, an Austrian-born British economist and political philosopher, insists the free market order, against the Keynesian and collectivism known. In Hayek's writings, there are a number of the rule of law, rights, democracy and the fundamental constitutional and other national views and opinions were discussed in detail. This article is by combing the state theory of Hayek and research, to try to discuss sexual issues. And as a starting point, Hayek's view of the state should bring us enlightenment. In this paper, the first chapter of Hayek's theory of origin of state theory, and some key concepts of production process was described in detail. Then in the second chapter introduces the basic theory of the state theory of Hayek, including the Methodological Individualism, Evolutional Rationalism, Spontaneous Order and the theory of social rules.In the third chapter of the content of Hayek's view of the state sort out and discussed in detail, covering the view of the rights, thought the rule of law, limited reconstruction of democratic theory and constitutional ideology. In the last chapter, we discuss the theoretical value of Hayek's view of the state, focuses on the classical liberalism of Hayek on the maintenance of the present democratic system prevailing concept of reflection and the rule of law for reference.
