The Regulations on Property Management in China became effective on September 1, 2003. Its implementation plays a great promotion in healthy and order development of real estate industry and property management in China. However, property management in China has started just for a short time which is a new-rising industry, some issues on laws are still at theoretical research and practical exploration and they are not ruled out in the Regulations on Property Management and lead to disputes in academic circle and practice circle. Of them, legal nature and status of the owner's committee are the issues with the biggest and widest dispute in current property management activities.This text clarify the role of Owners'committee and the necessity to understand the legal position of Owners'committee. Combine the questionnaire research and the actual situation, find out the existent problem and the contradiction of the owner committee, then analyse the reasons from the contradiction, tries to make this owner autonomy organization develops the working talent that it should contribute efforts to the owner benefits better. Promote the norm of the property management behavior and push the healthy development of the property management. Following is the conclusion:The owners'committee shall have the qualifications of civil, civil liability, also it should be admitted to the unincorporated organization, so as to play its role and fulfill its responsibilities better, to protect the legitimate owners'interests better.
