On The Achievement Of Judicial Efficiency

As we all know, judicial inefficiency lead to miscarriage of justice. The current judicial practice in China, the problem of judicial inefficiency is still widespread, even quite serious in some areas. As a result of inefficient judicial cases complaints can not stand long, long time not stand trial, the trial does not end a long, long time executive failed and so frequently occur, which severely restricted the operation of the judicial process and rule of law, but also makes the litigation interests of the masses and even the physical rights are being infringed. This spirit of writing and ideas to solve this problem, first described the meaning of judicial efficiency, value, then the efficiency of the various factors affecting judicial analysis, and finally to improve judicial efficiency in the analysis of errors based on the efficient administration of justice from abroad related systems to explore ways to realize our judicial efficiency. The article is divided into three parts:The first part, for an overview of judicial efficiency. First, from a different perspective of the meaning of judicial efficiency, effectiveness and efficiency of the system that is the case, the trial time efficiency, resource efficiency and litigation costs of judicial efficiency, effectiveness of the Court, the judge efficiency and the efficiency of participants in the proceedings (this time to investigate the efficiency of the trial court); Secondly, from the speed, impartial and authoritative several aspects of the value of judicial efficiency and fairness of judicial efficiency and justice, the relationship between the judicial authority.The second part, for the realization of the factors affecting judicial efficiency. Mainly from the social and cultural level factors, the judicial system factors, factors that the trial mechanism, judicial participation in the four aspects of the main factors that were described.The third part, the promotion of judicial efficiency is achieved at this stage some suggestions. First, China's current pursuit of improved judicial efficiency should be avoided and the analysis of several errors; Then, in the second part, four levels of factors affect the efficiency of the judicial framework, seize the key points, suggestions for improvement, namely:optimal operation of justice macroeconomic environment; improve and strengthen the independence of our judicial system; reference summary several European countries related to the system, improve our system of summary procedure; learn from the U.S. law judge system model, improve our judge system and management mechanisms.
