Personnel lawsuit system is established in civil procedure in most continetal . This lawsuit system addresses in the disputes of marriage and family relations, this dispute identity is actually relatives struggle between the friction and Family member, which was woven in litigation contain blood, affection and emotion. From this angle consideration, not only the general execution system is hard to be justice in this special identity relationship of action, but also it is hard to safeguard the rights of disadvantaged well. Analysising of personnel litigation execution system is useful for constructing the harmonious society, but also in the judicial practice has an important guiding significance. To ensure maximumly execution smoothly, to maintain the parties of the emotional and psychological,to prompting family harmony and stability of society. However the Personnel lawsuit system is not established in our country right now,even the execution of the Personnel lawsuit is only appeared in single aticle. Therefore,it has important significance to establish and perfect the personnel litigation system. This article named "personnel lawsuit execution system research", analysised on the foreign personnel litigation execution system, used the method of comparison, implement a system of personnel litigation discussion, to analyze the execution system speciality, and to proposed in this foundation in establishing personnel litigation execution system of some assumptions, with expectations on our country's judicial practice affected.This paper is divided into four chapters except preface and conclusions . The first chapter is basic theory of personnel litigation execution system. This chapter introduces the personnel procedural legal connotation, analyzes the meaning and particularity of this system, introduce the basic connotation and characteristics of personnel litigation and analyzed problems related the main body of the personnel litigation execution.Chapter two is the comparison of main countries and regions about personnel litigation execution system. This chapter firstly introduces the United States, France, Germany, Japan and Taiwan for personnel litigation execution system relevant provision, then comparative analysis the institution of those countries and regions to discusses about the commonness and individuality.The third chapter for present situation and defect of our personnel litigation execution system. This chapter firstly discusse from our own theory research situation about the legislative,judicial interpretation status and judicial practice status in our country personnel litigation execution system. Then, the article analyzes the defects of our our country personnel litigation execution system from apply for execution and applicant executor of personnel litigation execution.The fourth chapter for the consummation of our personnel litigation execution system.This chapter proposal for perfect our personnel litigation execution from personnel litigation legislation style and content enforcement system. Proposeing some opinions and suggestions after elaborating some aspects , included set chapters to regulate,the introduction of mental damages, increase psychological expert psychological counselling and perfect execution supervision procedure.
