The Dissertation Of Open Questions And Countermeasures Of Chinese Guild Developing

The gild organization has played an important role in developing our market economy, transforming the government function and solving the trade conflict. The gild refers to "the juridical person of a non-payoff organization which is formed by several management units on the basis of free will and who conduct the cargo and service transaction". It is different from other civilian organizations in its members, nature, purpose and function. From 1979, after the economic reform, the guild organizations gradually came into being. Although they have developed very quickly, the overall quality of our guild organizations is still far from solid. It is reflected as following: the law of guild association is not perfect, lack legitimacy. The function of the guild organization is implicit and the orientation is deviated. The official colour of guild organization is strong and thus their autonomy is relatively limited. The mechanism of entrance permition of guild organization is too rigid and meanwhile, the management is confused. The internal ability of the guild organization is insufficient in construction and have obvious commercial inclination. Through an analysis of question of the guild organization, we can find that the attitude of the government and society to the citizen's organization, the guild organization's own construction ability and the intensity of transforming the government function are three basic reasons influencing the development of the guild organization in our country. Therefore, in terms of the perspectives of fostering and management, I proposed the following methods: accelerate legislation, create legal system environment for development of guild organization; change government's function conscientiously, implement the function and legislate as soon as possible; advance non-governmental process of taking , guarantee independent character of guild organization; strengthen supervision and management, standardize the development of association; classify and manage the non-government organization, increase the input into guild organization.
