It has been raising a large quantity of funds for the social public enterprise, and obtaining a lot in social performance. At the same time, the lottery ticket market has been grown from no to have, arriving the big development gradually since the childhood, and also has the trend to speedup the progress. Currently, the lottery ticket industry has become a burgeoning industry which has infinite space in development in our country, it not only play an important role in the particular realm, but also affect the development of various professions, such as publish, print, television, broadcast, transportation and so on. Therefore, develop the lottery ticket industry of our country actively, will bring more positive influence to the development of economy and society of our country.However, as anything else, the lottery ticket also has two sides, it is a carrier of gains or losses concurrently. If there is no perfect law system, or no one take charge of it, then various problems will bring about in the operating process of the lottery ticket industry. For example, lottery ticket becomes the wager, the embezzlement of lottery ticket to win a prize, the deluge of illegal lottery ticket and the underground private lottery ticket, the impact of offshore funds try to usurp, etc. Undoubtedly, These problems would baffle the sustainable development of our country's lottery ticket industry. In regard to the state of our country, it was many years that the lottery ticket started to publish up to the present, and the set of some related law regulation with the document, management in lottery ticket market have been published, and obtain some experience of operating and managing of the lottery ticket market. Because of lacking a systemic, complete, perfect, convenient- operating law of lottery ticket, which is not match to the fast development of lottery ticket industry itself ,various law dispute caused by the publishing of lottery ticket and the operating of the market, can't be solved by the current law, then arose many fatalsocial problems. These problems not only impact the development of the lottery ticket industry itself, but also impact the stability of our society, then produce negative influence on the development of economy and society. The notorious Xi'an BMW fraud is a typical instance.Consequently, a set of systemic, complete, perfect, convenient- operating law of lottery ticket is urgent need today.Setting the law for lottery ticket, what we should do firstly is to have a definite cognition of the character of lottery ticket in law, to make clear the civil law-relationship and criminal law-definition, and secondly, what should do is to comply with the current laws and principles in our country, to draw lessons , basing on the thorough analysis of a serial of problems due to the loss of lawmaking, from foreigners' experiences, to give a good link between lottery ticket law and current laws, to define more clearly the aim, level, form and content of our lottery ticket lawmaking, and to make a full and systemic lottery ticket law corresponding to the state of our nation. We could get a sustainable development of lottery ticket industry only by this way. The paper tries to give a serial of study and research on the problems talked above, and hopes to give some policy-suggestion on our lottery ticket lawmaking.This paper is divided into three parts: The first part expatiates the legal definition, character and relationship of lottery ticket started from the definition and properties of lottery ticket .the second part evaluates and discusses the necessity and feasibility of the legislation of lottery ticket in out country, and gives the principles we should insist on in this legislation. The last part gives some countermeasure and advice on the construction of the legislation of lottery ticket in our country.
