Study Of Land Exproriation System Reformation And Security Of Right Of Farmer In China

Land expropriation is the legal action based on the public interests, which transfers the collective land to state-owned land according to legal process, and should provide reasonable compensation and appropriate settlement to the collective or individual. Now, our Country's economy is developing fleetly, and the much higher demands on non-farm construction land have been put forward. However, many problems have appeared abroad during expropriating the country's collective land, and infringe directly the prime interests of country collective or countrymen, aggrieve the essential rights of farmers. All these will result in severe social stabilization issue. To guarantee the essential rights of farmers faithfully, the current land expropriation system should be reformed.This article analyzes the problems of land exproriation compensation and settlement in China, indicates that the current land expropriation system has many disadvantages and had handicapped the use and allocation of land resource.
