How Law Runs In The Environment Governance In The Chinese Urban Communities

The impulse to initiate this dissertation was originated from my ordinary life. We have been experiencing the rapid increasing of both environmental problems and environment laws since the Reform and Opening-up was adopted. Obviously, there is a gap between the law and the society.This dissertation explores the gap by analyzing how law runs in the governance on environment in Chinese urban communities. Maybe there will be not enough answers to the questions like "how to bridge the gap" in this dissertation, but there are answers to the questions like "how does the gap look like" and "how does the gap come into being".It must be pre-requisite to make definition of the concepts related to this dissertation. Community, environmental problems and governance are three pivotal concepts in this dissertation. The effort to make definition of these concepts serves two purposes: avoiding misunderstanding on the concepts and setting forth the theoretical background that affects this dissertation. For the intention of this dissertation is to find out how law runs, it is necessary to provide a panorama of the laws that are currently effective on the governance on environment in Chinese urban communities. The analyses are based on the field survey by the means of individual interview and participative observation. In order to get closer to the fact, the analyses are made scattered. On the basis of the preparatory research work, there are three subjects which are discussed systemically: the government's strategy for the law enforcement, the multi-interactions among the society during the progress of the law and the self-governance organizations' function in the governance on environment in urban communities. These three subjects affective the law progress profoundly. For two reasons, there is no answer to the question "how to improving the governance on the environment in the urban communities" in the final part of this dissertation. One of the reasons is that the main intention of this dissertation is to analyze the progress of the law; the other is that after the research work, the governance on environment in the urban communities comes to be more complicated and any proposal that I can bring forward seems to contain too much liberties.
