Countermeasures Against Problems In The Reform Of Provincial System Of Administrative Examination And Approval In Hubei Province

Administrative examination and approval System has come into being since the fifties of the 20th century in china as the result of the planned economic system, serving as a major means to implement governmental administration. With the development of reform and market economy, the existing system has formed obstacles to the further development of social economy and thus calls for prompt reforms. Under such circumstances, Hubei Province started its own reform in provincial system of administrative examination and approval. From October 2000 to September 2001, the Government of Hubei Province has canceled and transferred 890 cases of administrative examination and approval, down 43.8%. But until the issue of the draft of " Law of Administrative Licensing ", the reform has not produced any anticipated effect. Tracing back to the source of its failure, we find that the reform, far from going further, bears many drawbacks. Among other things, the lack of the proper guidance of the scientific theory is the root of its failure and the cause of other companion problems. The reform fails to tackle the confusing situation caused by the abuse of the power of administrative examination and approval. So to accelerate the development of socialist market economy and better the investment environment in Hubei Province, we must struggle to improve the reform of administration examination and approval system. Firstly, we should regard the limited government as the director of the reform. Secondly, we should administer the state according to laws, preventing and extinguishing the abuse of the power of examination and approval. Thirdly, we should replace various kinds of formalism with substantial reforms. Fourthly, we should put forward governmental reforms relevant to the examination and approval system. Fifthly, we should change the traditional governmental regulation model to serve the society.
